Welcome to ITM Care Connect™, a referral and marketing platform operated by ITM Enterprise, Miami, FL. By accessing or using our website, services, or communications, you agree to comply with the following Terms of Service. These terms govern your relationship with ITM Care Connect™ and outline the legal boundaries of our services.

1. Nature of Services

ITM Care Connect™ is not a healthcare provider and does not offer medical, legal, or clinical advice. Our platform facilitates introductions between families, hospitals, case managers, and licensed care providers. All listed providers are independently licensed and responsible for their own compliance with applicable laws and regulations.

2. User Responsibilities

Users agree to provide accurate information when submitting care requests or provider details. Misuse of the platform, including false submissions, unauthorized access, or interference with referral processes, is strictly prohibited. Users must not rely on ITM Care Connect™ for medical decision-making or emergency services.

3. Provider Participation

Licensed care providers who join the network must maintain current licensing, respond to referrals promptly, and comply with all applicable Florida and federal regulations. Participation is governed by a Provider Participation Agreement (PPA), which outlines referral fees, obligations, and termination rights.

4. Referral Fees

Referral fees are paid by providers only after a verified placement occurs. ITM Care Connect™ does not charge families, patients, or case managers for referrals. All fee structures are disclosed in writing and comply with Florida Statutes Chapters 400, 408, and 429, and the Patient Brokering Act (§817.505).

5. Data Privacy and Security

All data submitted through the platform is handled in accordance with HIPAA and Florida privacy laws. ITM Care Connect™ uses encrypted systems to protect personal and health-related information. For more details, refer to our Privacy Policy.

6. Intellectual Property

All content, branding, and technology associated with ITM Care Connect™ are the property of ITM Enterprise and may not be copied, reproduced, or distributed without written permission. Unauthorized use of platform materials is prohibited.

7. Limitation of Liability

ITM Care Connect™ is not liable for the actions, omissions, or outcomes of any care provider listed on the platform. We do not guarantee placement, admission, or service quality. Users and providers assume full responsibility for their decisions and interactions.

8. Modifications

ITM Care Connect™ reserves the right to update these Terms of Service at any time. Changes will be posted on our website and become effective upon publication. Continued use of the platform constitutes acceptance of the revised terms.

9. Governing Law

These Terms of Service are governed by the laws of the State of Florida. Any disputes arising from use of the platform shall be resolved in the courts of Miami-Dade County, Florida.
